BOOKING TERMS & CONDITIONS

These Terms & Conditions apply to all bookings made with Westpoint Studios, operated by Ambitone Studios Ltd and WP Productions Ltd, as specified on your booking confirmation and invoice.

Westpoint Studios operates multiple recording and production facilities within the Westpoint Building complex.

The contracting legal entity responsible for each booking shall be the company named on the relevant booking confirmation and/or invoice.

All references to “Westpoint Studios” within these Terms shall be deemed to refer to the applicable contracting entity for the specific booking.

By confirming a booking, the Client agrees to the following Terms & Conditions.

1. DEFINITIONS

Agreement – The contract formed between Westpoint Studios and the Client, including the booking confirmation and these Terms.

Booking – The hire of any studio, room, or facility for the agreed period.

Booking Fee – The total शुल्क payable for the session, excluding VAT unless stated.

Client – The individual, artist, label, company, or representative making the booking.

Studio – Any room, control room, live room, production suite, or ancillary space within Westpoint Studios.

Recording – Any audio, visual, or digital material created during the booking.

Master Recording – The final recording produced during the session.

Client Personnel – Artists, producers, engineers, guests, or third parties invited by the Client.

Client Equipment – Any gear brought onsite by the Client.

2. BOOKINGS & CONFIRMATION

2.1 Bookings are only confirmed once payment (deposit or full fee) has been received and acknowledged in writing.

2.2 Westpoint Studios reserves the right to release tentative bookings without notice until payment is received.

2.3 Session times include setup and pack-down unless agreed otherwise.

2.4 Overtime is subject to availability and charged at the studio’s prevailing hourly rate.

3. PAYMENT TERMS

3.1 Full payment or agreed deposit is required in advance of the booking.

3.2 All rates are quoted exclusive of VAT unless stated.

3.3 Additional charges may include (but are not limited to):

  • Overtime

  • Assistant / engineer fees

  • Equipment hire

  • Piano tuning

  • Session musicians

  • Materials / hard drives

  • Catering / hospitality

  • Taxi or transport costs (if applicable)

3.4 Invoices must be settled within the stated payment terms. Late payments may incur statutory interest and recovery costs.

3.5 Westpoint Studios reserves the right to withhold recordings and materials until all invoices are paid in full.

4. CANCELLATION & RESCHEDULING

4.1 All cancellations must be made in writing.

4.2 Cancellation charges:

  • More than 7 days notice → Deposit transferable once (subject to availability)

  • Less than 7 days → 50% fee payable

  • Less than 48 hours → 100% fee payable

4.3 Rescheduling is permitted once if requested within the agreed notice period.

4.4 Failure to attend a session is treated as a late cancellation (100% payable).

5. STUDIO USE & CONDUCT

5.1 The Client is responsible for all persons attending under their booking.

5.2 Westpoint Studios reserves the right to refuse entry or remove individuals for:

  • Unsafe behaviour

  • Abuse toward staff

  • Illegal activity

  • Excessive intoxication

  • Breach of studio rules

5.3 Prohibited onsite:

  • Illegal substances

  • Smoking or vaping inside

  • Open flames

  • Weapons

  • Hazardous materials

5.4 Clients must respect noise limits and neighbouring premises where applicable.

6. EQUIPMENT & DAMAGE

6.1 Clients are liable for any loss or damage caused to studio equipment, furniture, or facilities.

6.2 Repair or replacement costs will be invoiced at full market value.

6.3 All client equipment is brought onsite at the Client’s risk.

6.4 Westpoint Studios accepts no liability for loss, theft, or damage to client property.

7. RECORDINGS, FILES & STORAGE

7.1 All recordings remain the property of Westpoint Studios until paid in full.

7.2 Upon full payment, ownership of the Master Recording transfers to the Client (unless otherwise agreed).

7.3 Session files are stored for 30 days after the booking.

7.4 After 30 days, files may be permanently deleted without liability.

7.5 Clients are solely responsible for backing up their data before leaving the studio.

7.6 Hard drives and media left onsite may be disposed of after reasonable notice.

8. INTELLECTUAL PROPERTY

8.1 Copyright in the Master Recording transfers upon full payment.

8.2 Westpoint Studios retains the right to use session credits, artist names, and non-confidential imagery for promotional purposes unless declined in writing.

8.3 Any production, composition, or creative contribution by Westpoint staff must be credited and agreed commercially where applicable.

9. CONTENT WARRANTY

The Client warrants that recordings will not contain material that is:

  • Infringing copyright

  • Defamatory

  • Obscene or illegal

  • In breach of third-party rights

The Client indemnifies Westpoint Studios against all claims arising from content created during the session.

10. HEALTH & SAFETY / SOUND LEVELS

10.1 The Client acknowledges that prolonged exposure to noise levels exceeding 85 dB(A) may cause hearing damage and that, under the Noise at Work Regulations 1989, both studios and their users are legally required to keep noise exposure as low as reasonably practicable. Accordingly:

10.2 Exposure to high sound levels is at the Client’s risk.

10.3 Westpoint Studios may reduce levels or stop sessions if safety thresholds are exceeded.

11. STUDIO BREAKDOWN

11.1 If technical failure prevents continuation:

Westpoint Studios may:

  • Extend the session, or

  • Offer a partial refund/credit

11.2 Liability is limited to the booking value.

12. LIABILITY LIMITATION

12.1 Use of the studio is at the Client’s risk.

12.2 Westpoint Studios is not liable for:

  • Loss of profits

  • Loss of opportunity

  • Data loss

  • Reputational damage

12.3 Total liability is limited to the amount paid for the booking.

Nothing excludes liability for death or personal injury caused by negligence.

13. INSURANCE

Clients are responsible for insuring:

  • Their equipment

  • Personnel

  • Recording media

Proof of insurance may be requested for commercial bookings.

14. CONFIDENTIALITY

Both parties agree to keep confidential:

  • Unreleased music

  • Session details

  • Business information

  • Artist, performer, creative or label activity

15. PHOTOGRAPHY & FILMING

15.1 Filming or photography for commercial use requires written permission.

15.2 Westpoint Studios may capture behind-the-scenes content for marketing unless declined.

16. FORCE MAJEURE

Westpoint Studios is not liable for failure to perform due to events beyond control, including:

  • Power outages

  • Flood / fire

  • Government restrictions

  • Industrial action

  • Equipment supply failure

17. GENERAL

17.1 These Terms form the entire agreement.

17.2 Amendments must be in writing.

17.3 If any clause is unenforceable, remaining clauses remain valid.

18. ADDITIONAL STUDIO-SPECIFIC TERMS

18.1 Noise Between Studios

Due to the close proximity of Studio 2 and Studio 3, sound transfer or noise bleed may occur.

Whilst we take reasonable steps to manage isolation and scheduling, complete acoustic separation cannot be guaranteed and shall not constitute grounds for refund, cancellation, or fee reduction.

18.2 Dry Hire & Floating Assistant

Dry hire bookings include access to a shared (“floating”) assistant.

The assistant will attend as soon as reasonably available if engaged in another studio.

Dedicated assistants may be booked at an additional cost.

18.3 Session Confirmation & Payment Commitment

Once a session is confirmed, we reserve the studio exclusively and turn away other bookings.

Accordingly, the full booking fee remains payable regardless of cancellation, non-attendance, or early termination (subject to the Cancellation Policy).

18.4 Equipment Use & Liability

Clients must use all equipment responsibly and as instructed.

Damage resulting from:

  • Misuse

  • Negligence

  • Abuse

  • Unauthorised operation

  • Incorrect handling

will be charged for repair or replacement at full market cost, including associated downtime or sourcing costs.

18.5 Equipment Access Restriction (Tightening Clause)

Westpoint Studios reserves the right to remove, restrict, or supervise access to any equipment where misuse, negligence, or risk of damage is suspected.

Failure to comply with staff instruction regarding equipment use may result in session suspension or termination without refund.


19. GOVERNING LAW

This Agreement is governed by English Law.

All disputes fall under the jurisdiction of the Courts of England & Wales.
